ebay question

i won a knife and paid on may 5th, finally got it yesterday. Well its a pretty nice old folding hunter that was listed with no cracks. The knife is cracked on both sides from the lower pin to the bolster and has a piece missing about a 1/8th wide 1 1/2 inches long running down one side of the liner. I contacted him, he denied it, but said to return it. Which i did yesterday right before the post office closed. Well i gave over $300.00 for the knife. What i want to know is? Should I open a dispute, then close it after i get the refund. Or just wait? I usually just wait, but the seller doesnt seem to be dependable at all.

I would open a dispute now. if he has already lied to you about the condition ofthe knife, hee obviously is a heel.
Tell him you will close dispute when you recieve full refund.

I would say YES, open the dispute thru PayPal (assuming that is how you paid). Unless the rules have changed, you must enter a dispute within 30 days of the auction. Since it took over half of that time just to receive it, then you only have about 2 weeks to dispute it. You can still hope for the best, but I would protect myself through the dispute process.

You shouldn't have any problem getting your money back. I had to do it once as a "not as described"; and had no problems. There are some nuts out there though; I paid with pay-pal which ruled in my favor. Then the seller tried to file a "non-payment claim" on me; eBay wiped it off of course. I would file it as a "not as described" ASAP. eBay will close the dispute; when the matter is settled.

Actually you have to wait 2 weeks from end of auction in order to start the dispute process. (regardless of shipping time)

If you used Paypal you have buyer protection. If it was only $30, I'd shake his tree a little, but for $300.........call in the big guns. The guy missrepresented the item, and seems unwilling to work with you. I say cover yer arse, you can always retract the disspute if he does the right thing.

As a buyer and a seller on Ebay .... PLease, Please open a dispute as soon as possible, as others have stated, you can always retract the dispute.
By creating the dispute you place pressure on the seller to resolve an issue, which i hope he will do in a timely manner.

This guy is crooked as a snake, he opened a claim against me. This is what he said!
Seller escalated this dispute to a Claim.
5/25/2010 15:27 CDT - Seller: Buyer has made a clumsy attempt to clean portions of the blade and the bone and in fact has ruined the blade finish and the bone color. Apparently the buyer is of the opinion that he can go into a clothing store and buy a piece of clothing and then wash and dry it and cut the fabric in an attempt to make it more interesting. This may be true when it comes to clothing but it certainly is not true when it comes to antique knives. By cleaning the finish from the blade and removing the oxidation, as well as damaging the bone, the buyer has reduced the value of this knife to less than $100.00. He should have just left the knife alone and resold it in order to get his money back. Now he is attempting to get all of his money back and return the knife to me to accept his loss due to his foolishness.

He's lyeing about everything, i looked at the knife and send it right back to him. Anybody that knows me, knows I dont clean knives,,I usually wont even buy them. The Seller is LITTLEDUKDOM or Ruanne E. Smith!
This is a bunch of bull crap, he's a freakin lier!

I either sent it back later that day or the next morning. Yes he has it. He knows i didnt touch it. The guys just a flat out lyeing crook. I was going to give him nuetral,,,not i got time to think of some real awfull feedback to give him. The auction says full refund if not satified he also said send it back for a full refund.

If the seller does not provide good, clear pics. of a knife, I recommend to STAY AWAY! How many good close up pics did you get to see of this knife? I must have decent pictures or I'm not buying.

Go to the phone and call: 888-215-5506 That is the number I have for PayPal. Or, call 866-643-3720 That is what I have for an eBay number. I haven't used either in a long while, but I had them both in my files. Hope this does you some good, Eric

The same thing happened to me once. The knife was not as described so I contacted the seller and he said " no problem, just send it back" so I did then he put in a claim against me for ruining the value of the knive by cleaning it. NOW he had my money and the knife. I was new to e-bay and he was A well seasoned cheat. He ended up sending me the knife back with a meassage that said "You break it you buy it" I still have that knive and it still makes me made, but I learned a leason. Hey, don't give up like I did, keep your cool, I think you have a good case. Good Luck.
